GENERAL BUSINESS POLICIES - 2021

*Notice: Upon the addition of this policy to business conduct, expectations and operations, this list of policies do not override the pricing structure(s) of services and products advertised or as advertised. Package prices are what they are. The policies set forth regarding any pricing set the general reference and starting point for any further pricing.

**The policies stipulated are subject to change as needed. With any change, addition or alteration made, notification of update date will also be included.

BUSINESS POLICIES

As an online / web-based business, our regular business hours are 9am to 5pm Mondays to Fridays and 10am to 4pm on Saturdays and Sundays. However, if you are unable to schedule during that time we can schedule outside these hours.

SERVICE REQUESTS

ESTABLISHING A SESSION

We prefer for all sessions to be cultivated thru online contact (included but not limited to the completion of Contact Forms, Booking Scheduling, and Service Questionnaire) as directed.

Booking and Scheduling a session more solidifies a Formal Consultation requiring the stipulated fee(s). Thru consultation, all forms directed to be completed must be completed to ensure the creation of a Creative Session.

ART

The Creative Session in developing an Artistic Project and Product requires a complete understanding of the desired elements and aspects of the piece to meet Client Expectations and Standards.

DESIGN

The Creative Session in developing a Design Project and Product requires a complete understanding of the desired elements and aspects of the product to meet Client Expectations and Standards.

PHOTOGRAPHY / VIDEOGRAPHY

More complicated and sophisticated in nature, the Creative Session for developing a Photography / Videography Project and Product requires a complete and comprehensive understanding the desired elements and aspects of the product to meet Client Expectations and Standards. The Photography/Videography process may incur additional sessions and circumstances of review to produce the desired results.

CLIENT REQUESTED SESSION

Be prepared to spend up to 2 hours at your session. This allows us to relax and not feel rushed. If you are running late please telephone us. If you are more than 15 minutes late without notifying us, we will assume you are not coming.

LIAM IAN LLC REQUESTED SESSIONS

For specific projects, we will reach out to contract and hire model (as talent) to be shot. We establish a compensation structure that is industry competitive ensuring that the model is being valued measured on Scheduling, Availability, Aesthetic and Appeal, Grooming, Clothing, and other associated elements.

We offer both “studio” and on location sessions. Location sessions can be held inside or outside, in your home or at an alternative location. Please discuss your choice of location with your photographer as the time of day will effect where you can go. If you are unsure we can suggest several locations.

EXCLUSIVE PHOTOGRAPHER

Please do not bring your own camera, camcorder or any other recording devices to your session, or allow any family members to do so. If this situation occurs, the photographer reserves the right to terminate the session. If your session is terminated in this way, there will be no refund given.

CANCELLATION/RESCHEDULING

CANCELLATION

Not all cancellations will incur a refund. If the need arises to cancel your appointment please do communicate it at least 48 (2 days) hours prior to your session. This is required for a refund to be implemented. If a cancellation is made before the 48 hour requirement, a refund of 75% of paid fees is made with remaining balances dissolved. Cancellations made after the 48 hour requirement will incur NO REFUND with remaining balances dissolved. Cancellations are noted on the Client Account for future reference. Refunds can and may take up to 2 weeks to be implemented.

*Cancellations for Special Shoots (as in Holiday or Commercial Events) are under the review and descretion of LIAM IAN LLC to determine refund availability. Cancellations for shoots to be done on or immediately around (12 - 24 hours before or after) a holiday must be review to assess the loss of any work opportunities due to the scheduling of the shoot and then the associated cancellation. Cancellations due to the presence of a holiday while the shoot not having any association with a holiday will additionally be reviewed and assessed. LIAM IAN LLC reserves the right to refuse any refund for a cancellation that severely affects the attainment, creation and/or implementation of other potential work. (Proof of work opportunity potential must be provided thru legal means for any legal proceedings.)

RESCHEDULING

Aside from a Cancellation, the Rescheduling of Shoot and/or Creative Session is much easier to implement. Rescheduling may not incur any additional fees but there is no guarantee of this due to the associated scheduling and use of assets and/or resources. 2 Reschedules are allowed with the 3 attempt considered a Cancellation. Each allowable Reschedule can only be for a date open and available by LIAM IAN LLC with that date within 1 week of the planned Session Date.

If you, or anyone being photographed, are feeling sick we do suggest rescheduling. Sick people generally do not enjoy being photographed and this will show in your portraits.

RE-SHOOTS

Reshoots are offered at the discretion of the photographer only and will not incur an additional session fee. We do not offer to reshoot for unfortunate personal/professional choices of the client such as hair, clothing, etc. If a Reshoot is needed due to failures, errors or mistakes—as reviewed, acknowledged and approved by LIAM IAN LLC—made by LIAM IAN LLC, the client will be notified with the reshoot done free of charge.

DISCOUNTS & PROMOTIONS

From time to time we will run special promotions. These sessions are run for a limited time only and session spots fill up fast. If all session slots are full the photographer is under no obligation to extend the promotion or match the offer past the expiration date.

RETOUCHING

All selected images receive basic editing and retouching. We only retouch temporary things such as stray hairs, spots, acne, etc. If it is permanent, such as a birthmark or scar we will not retouch or remove it unless specifically asked. We do apply special edit presets to change and adapt the “tone” and “feel” of the images as they should meet the project and client expectations.

GRAPHIC DESIGN SERVICES

We design all additional items ourselves. When ordering greeting cards, etc you will be shown a selection of designs. You will be allowed one change per design. Additional changes are subject to design fees starting at $20 per hour with a one hour minimum.

For session albums you will be required to indicate whether you would like color or black and white images. For coffee table books, the photographer will make the choice based on artistic selection. The client will have a chance to view the coffee table book design before the photographer sends it off to their printing lab.

USAGE RIGHTS

The photographer has the exclusive right to make reproductions of the images as to meet any project and business operational needs (including but not limited to the creation of associated branded products, educational and/or promotional materials, and/or use in social media). The photographer shall only make reproductions for the client or for use in the photographer’s portfolio, advertising, samples, website and display within or outside their studio. The photographer also has the right to enter these images into photographic competitions, art exhibitions or publications.

COPYRIGHT

Copyright for all images is the sole property of LIAM IAN LLC and protected by Federal Copyright Law. It is ILLEGAL to copy, scan, print or reproduce these images in any way without written permission from the photographer, William B. Philpot IV / Liam Ian (). This includes scanning or downloading images for the purposes of emailing or printing them at home. Doing so may result in fines up to $150 000.

No identifying names will be given in connection with usage of any image. We understand that sometimes there are circumstances where you may wish for your images not to be used for any of these purposes. Please notify the photographer if this is the case.

No fees, royalties, or payment of any kind will be owed in connection with any usage made of any image captured or created by LIAM IAN LLC unless specifically negotiated and agreed upon via Service Contract Agreement.

WAIVER OF LIABILITY

If the photographer cannot fulfill the terms stated in the Service Agreement, due to causes beyond the control of the parties involved, the client shall have no further liability in respect to the agreement. In the event that photographic materials are lost or damaged, without fault on the part of either party, the limitation will also apply. In such cases, LIAM IAN LLC is not liable.

The client releases LIAM IAN LLC, and employees, associates and/or representatives of LIAM IAN LLC, from all liabilities, claims and damages that may result from any accidents or incidents that may happen during the session, except to the extent that the accident or incident is the direct cause of the photographer’s willful and careless conduct. Please see our reshoot policy.

ONLINE GALLERY

Approximately 7 days after your session your proofs will become available for you to view in an online, personal, password protected gallery. You will be able to pass on the gallery information to family and friends, so they may place their own orders. Please remember that it is a violation of Federal Copyright Law to copy, save or print the images within the gallery.

Standardly, the online gallery should be available for 14 days however this could be extended due to operational reasons. Once the 14 day limit has been reached, it is at the dIscretion of LIAM IAN LLC to when the gallery will be removed. LIAM IAN LLC is under no obligation to notify the client of when the gallery is being removed.

Orders placed within 48 hours of gallery posting will receive a 10% discount on print and product prices. There will be a $30 reloading fee if you wish to have your gallery available for an additional 14 days once taken down.

ARTISTIC SELECTION

While many images are captured during the session, afterwards each image is put through a careful selection process. You will see only the images that meet the high standards of the photographer. Images with eyes closed, unflattering poses and duplicate images are removed permanently after the photographer completes this selection process. The selection process is entirely the right of the photographer and part of the custom portrait process.

ORDERING

Full payment is due at the time of ordering. We DO NOT accept orders to be paid for by check. Attempts for check payments will not be accepted and are discouraged. Each image is printed to order and cannot be changed or canceled after payment has been made. All sales are final.

Orders placed within 48 hours of online gallery posting will receive a 10% discount. Sales tax of 7% will be added to your order total. Please allow 2 weeks for delivery of your portraits.

COMPLETE PROJECT IMAGE LIBRARY

We do provide the opportunity for all images captured to be purchased. They are provided in the CR2 (RAW) format and file structure including that of JPG. At minimum, the cost for providing all images captured during the project session begin at $2 per image within the complete library (as cumulative of all respective cameras and storage devices used). There is an additional cost for the storage device to be sold and used to contain the digital data. Discounts can and may be offered and applied for specific opportunities and circumstances.

PRINT & PRODUCT PRICES

Prices are subject to change at any time. The prices in effect at the time of your session will be valid for 30 days after your session.

REPRINTS

We keep all images on file for 1 year after your initial order. There is a $100 minimum order on reprints. You may place a reprint order at any time.

PAYMENT

We accept cash, Mastercard, Visa and Discover. Payment plans are available. Ask your photographer for details.

ARCHIVING

All ordered images are archived for one year from the date of your initial order. Images are kept on site for 30 days and then moved to an off site storage facility. Once your archived images have been moved to the off site storage facility a $30 fee will be required to retrieve them.

REFERRAL PROGRAM

For each NEW client referred to us existing clients can earn print credits to use at their next session. A $30 print credit is earned for each new client – refer 3 new clients and receive a $100 print credit. There is no limit to the credit existing clients can earn. New clients must present their referral card at the session and can only present one card. Referral cards are provided to existing customers, free of charge, with their portrait order.

Philpot IV) and all source code, databases, functionality, software, designs, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned and/or controlled by LIAM IAN LLC, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United State, foreign jurisdictions and international conventions.
